What the researcher's appeal says
By Brian Wallheimer

Here's a look at the specific grounds Purdue researcher Rusi Taleyarkhan lists for his appeal on his research misconduct case. Taleyarkhan claims that:

— Purdue University violated its own procedures by finding him guilty of charges that weren't advanced from the inquiry committee to an investigative committee.

He claims the investigative committee created the charges.

— Purdue officials falsified and misrepresented key facts in the case, including statements made by those testifying in favor of Taleyarkhan.

— Purdue wrongfully withheld key evidence, including sworn statements from researchers, Purdue staff and students.

— Presumptive statements, not supported by fact, were used by the investigating committee to come to conclusions of guilt.

— The 2008 investigative committee was not allowed to review an inquiry from 2006 that decided there was not enough evidence to launch an investigation of misconduct against Taleyarkhan.

— The committee that found Taleyarkhan guilty was in violation of Purdue rules because the committee members were not Taleyarkhan's peers.

He claims only one person on the committee of five was an engineer.

— A university official presented false information to the investigation committee that prejudiced the committee's opinion of Taleyarkhan. He claims letters that clarified the false information were not discussed in the final report finding him guilty.

— An attorney working for Purdue University, through a message left with a former Taleyarkhan attorney, threatened Taleyarkhan if he did not accept the committee's findings.

— A video was deemed inadmissible in which the student whose name was added to a research paper enthusiastically talked about his involvement with the research. Taleyarkhan was found guilty of adding that student's name knowing the student was not involved with the research.
